INTRODUCTION

The Promotion of Access to Information Act seeks to promote a culture of transparency, accountability and good governance, by giving effect to a person's constitutional right of access to information.

In furtherance to this objective, Section 51 of the Act requires private bodies to compile a manual, which will assist either private or juristic persons in obtaining information from such private body. PUREGAS' SCOPE

Sourcing, purification, blending of Butane and Propane gas in various grades and pressure supplied either in bulk or in 48kg cylinders. Sourcing and distribution of Dimethyl Ether in either 48kg cylinders or bulk.

PARTICULARS IN TERMS OF THE SECTION 51 MANUAL

In terms of Section 10 of the Act, The South African Human Rights Commission (SAHRC) must compile a guide containing information that may be required by a person who wishes to exercise a right in terms of the Act.

The guide is intended to assist users in the interpretation of the Act. The guide will contain a description of the objects of the Act, the contact details of the information officers of all public bodies, the manner of access to the records of those public bodies and the remedies available in law regarding a breach of any of the provisions of the Act.

3. HOW TO REQUEST RECORDS

To request any document in terms of the Act, the requestor must use the prescribed form. This must be submitted to the Directors of the Private Body.

The requestor must provide sufficient detail to enable the Private Body to identify the record and the requestor.

The requestor must identify the right that he/she is seeking to exercise or protect, and provide an explanation of why the requested record is required for the exercise or protection of that right. If the request is made on behalf of a person, the requestor must submit proof of capacity in which the requestor is making the request.

In terms of section 63 of the Act, the head of the Private Body may refuse a request for access to a record of the private body/CC/association if the record contains: trade secrets, financial, commercial, scientific, and technical information, the disclosure of which could harm the interests of the Private Body.

Similarly, in terms of Section 64 of the Act, the above refusal grounds apply in respect of the commercial information of the third party concerned, before the Private Body will permit access to view.

In accordance with the above mandatory refusal grounds, the Directors will make a decision whether to accede to a request for access to information.

Any search, reproduction and document preparation necessitated by requests for information will be undertaken in accordance with the prescribed fees.

 
4. FORM OF REQUEST

To facilitate the processing of your request kindly: Use the prescribed form, available on the website of the South African Human Rights Commission at www.sahrc.org.za, or the Department of Justice and Constitutional Development (under regulations) at www.doj.gov.za

Address your requests to the Directors

Provide sufficient details to enable the Private Body to identify:

  • The record(s) requested
  • The requestor (and if an agent is lodging the request, proof of capacity)
  • The form of access required
  • The postal address or fax number of the requestor in the Republic
  • If the requestor wishes to be informed of the decision in any manner ( in addition to written) the manner and particulars thereof
  • The right which the requestor is seeking to exercise or protect with an explanation of the reason the record is required to exercise or protect the right

5. PRESCRIBED FEES

  1. The fee for a copy of the manual as contemplated in regulation 9(2)(c) is R1.10 for every photocopy A4 size page or copy thereof.
  2. The fees for reproduction referred to in regulation 11(1) are as follows and may be amended from time to time:
1 The requestor is required to pay the prescribed fees before a request will be processed R50.00
2 If the preparation of the record requested requires more than the prescribed hours (six), a deposit shall be paid (of not more than on third of the access fee which would be payable if the request was granted)
3 For every photocopy of an A4-size page or part thereof R1.10
4 For every printed copy of an A4 size page or part thereof held on a computer or in electronic or machine readable format R0.75
5 For a copy in a computer readable form on - compact disc R70.00
6 For a transcription of visual images, for and A4 size page or part thereof R40.00
7 For a copy of visual images R60.00
8 For a transcription of an audio record R20.00
9 For a copy of an audio record R30.00
10 To search for and prepare the record for disclosure R30.00, for each hour or part of an hour
11 Records may be withheld until the fees have been paid
